If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in Sub-Clause 16.1 above takes away or reduces your rights as a consumer to rely on those provisions.
If you are a consumer, any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales.
If you are a business, any disputes concerning these Terms and Conditions, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England & Wales.
Charity Walk, Jog or Run
The Charity Walk, Jog or Run (The Event) is open to individuals of all ages. Participants under the age of 18 must have parental or guardian consent to participate.
All participants must register for The Event prior to the event date. Registration may include providing personal information such as name, contact details, and any relevant medical information.
Entry is by voluntary donation. All donations in return for entry are non-refundable with all proceeds going towards Horsfall House.
Participants are responsible for ensuring they are physically capable of completing The Event. It is recommended that participants consult with a qualified healthcare professional before undertaking any physical activity.
By registering for The Event, participants acknowledge and accept the risks associated with participating in a physical activity event. Participants agree to waive any claims against the event organisers, sponsors, or volunteers for injury, loss, or damage suffered during the event.
Participants are expected to conduct themselves in a respectful and sportsmanlike manner throughout the charity walk. Any behaviour deemed inappropriate or disruptive may result in them being asked to leave the route.
The Event may be subject to cancellation or postponement in the event of inclement weather, natural disaster, or other unforeseen circumstances. In such cases, every effort will be made to notify participants in advance, and registration fees may be refunded or transferred to a rescheduled event.
By participating in The Event, participants grant the event organisers the right to use their name, likeness, and photographs at any time for promotional purposes without compensation.
Participants are encouraged to raise additional funds for Horsfall House through sponsorship or donations. Any funds collected by participants are to be submitted to the event organisers in a timely manner.
All intellectual property associated with The Event, including but not limited to logos, trademarks, and promotional materials, are the property of the event organizers and may not be used without permission.
Participant information collected during registration will be used solely for the purpose of organising and promoting The Event. Personal data will not be shared with third parties without consent, except as required by law.
These terms and conditions shall be governed by and construed in accordance with the laws of Great Britain and Northern Ireland, and any disputes arising out of or in connection with The Event shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
By participating in The Event, participants agree to abide by these terms and conditions in their entirety.
